Responsibility

18. Arbitration Agreement & Class Action Waiver

18.1 Mandatory Binding Arbitration

You and SmutVibe agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of SmutVibe (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided below.

This arbitration agreement applies to all Disputes, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.

18.2 Exceptions

Either party may bring claims in small claims court if the claims qualify and remain in that court.
Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use or abuse of intellectual property.

YOU AND SMUTVIBE HEREBY WAIVE ANY RIGHT TO A JURY TRIAL for any Dispute to the fullest extent permitted by law.

18.5 Class Action Waiver

All Disputes must be brought in an individual capacity only.

You agree that:

• You may not bring a claim as a plaintiff or class member in a class, collective, representative, or private attorney general action

• The arbitrator may not consolidate claims or preside over any form of class or representative proceeding

If this class action waiver is found to be unenforceable, then the entire arbitration agreement shall be null and void.

18.6 Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to:

18.7 Survival
